VA Decision Reviews and Appeals

The VA does not approve every disability claim, and the people who review claims are only human—they are bound to make mistakes. As a result, you receive less benefits than you deserve. The VA gives you one year to have them review their decision. We can give you the best chance at obtaining or maximizing your VA benefits, utilizing VA accredited attorneys with a thorough understanding of Veterans law and a commitment to fighting for your rights.

There are three options, or lanes, for you to seek review of the VA’s decision: three lanes within the Veterans Benefits Administration—(1)Supplemental Claim, (2)Higher-Level Review, and (3) Appeal to the Board of Veterans’ Appeals. Don’t worry, if you are not happy with the results of the first option you choose, you can try another option that you are eligible for:

Supplemental Claim

  • Submit new and relevant evidence to support claim for VA Disability

  • Takes an average of 125 days to complete

  • If you disagree with the VA’s decision, you can request another Supplemental Claim, a Higher-Level Review, or a Board Appeal

Higher-Level Review

  • No new evidence can be submitted

  • One-time, informal conference with senior claims adjudicator

  • If you disagree with the VA’s decision, you can request a Supplemental Claim or a Board Appeal—you cannot request another Higher-Level Review

Board of Veterans’ Appeals

  • You can choose one of two board review options or an appellate hearing, all avenues being reviewed by a Veterans Law Judge

  • Direct Review—No new evidence can be submitted

  • Evidence Submission—Submit new evidence for review

  • Hearing—Hearing by teleconference, videoconference, or in person

  • If you disagree with the VA’s decision, you may request a supplemental claim or appeal to the U.S. Court of Appeals for Veterans Claims.
